Freedom of Speech, WikiLeaks and Ethics – I have some questions!

Rarely do I post a blog where my opinion isn’t clear…but it looks like this one will be one.  Why?  Because I have some questions and, honestly, I’d like some answers.

Over the past several weeks all we have been hearing on the news is about WikiLeaks – the release of government documents or communications and the WikiLeaks founder – Julian Assange.

So let’s start with some questions:

  1. Is WikiLeaks dissemination of information a form of Journalism?
  2. Is WikiLeaks only a publisher?
  3. In either case, is the publication of documents that comes into the possession of WikiLeaks protected by the First Amendment?

One year ago today, Bernie Madoff made headlines. His investment firm was nothing more than a big (minor understatement) Ponzi scheme. One year ago today most people didn’t know what a Ponzi scheme was and, frankly, most had not heard of Bernie Madoff. Bernie Madoff, in record time, admitted his guilt in what is now known as the largest Ponzi scheme or fraud in history and was sentenced to 150 years in prison. Today, he is safely tucked away in Federal prison in Butner, NC. Having observed this type of activity for years I must admit I am amazed at the speed of the investigation, guilty plea and sentencing. But then again, Madoff set a standard of fraud at a time when the nation was beginning to feel the real impact of the economic recession, so it would stand to reason that if the outcome of his transgressions was delayed…there would be a public outcry.

Are business schools effectively teaching ethics? That’s a good question to ask, especially now. The other day, North Dakota State University’s longtime president, Joseph Chapman (right) resigned amid growing criticism over his expensive new presidential residence. Presidential is the operative word. Cost overruns exceeded $2 million, compared with the original $900,000 that had been budgeted for the project. But the good news doesn’t stop there. The Forum, a Fargo newspaper, reports that the donation-funded NDSU Development Foundation paid $22,000 on a charter flight and hotel bills for Chapman and his family to attend President Obama’s inauguration. (By comparison: University of North Dakota reportedly spent $2,176 to send its president, Robert Kelley, to the inauguration.) No surprise, Chapman resigned the other day. “It just isn’t fun,” he told the Associated Press.
